The offer and sale of products on the website www.martelligloves.com are governed by these General Conditions of Sale. Customers are required to carefully read these General Conditions of Sale before placing their Purchase Order. Submitting a Purchase Order implies full knowledge and express acceptance of both the aforementioned General Conditions of Sale and the provisions of the Order Form. Once the online purchase process has been completed, Customers are required to print and retain these General Conditions of Sale and the relevant Order Form, having previously reviewed and accepted them.
These General Conditions of Sale apply to the online sale of products via the e-commerce service on the website www.martelligloves.com.
Products sold on the website may be purchased and delivered exclusively to the countries indicated on the Order Form. Any orders for shipments outside these countries will be automatically rejected during the Order processing process.

The products are sold to the Customer identified by the data entered when completing the Order form, by sending it electronically, thereby accepting these General Conditions of Sale.
The product offers on the website www.martelligloves.com are intended exclusively for adult customers. Minors must obtain the prior consent of a parent or legal guardian to purchase products on the website www.martelligloves.com. Remember: this always applies, not only to our website, but to all websites you visit online: when browsing the internet, you see or are asked for information that you don't understand or that isn't clear to you, always ask your parents for assistance. By placing an order through this website, customers guarantee that they are 18 years of age or older and have the legal capacity to enter into binding contracts.
Customers are prohibited from entering false and/or invented and/or fictitious names during the online order process and in any further communications. The Seller reserves the right to prosecute any violation or abuse, in the interest and for the protection of all consumers.

By accepting these Conditions of Sale, the Customer further releases the Seller from any liability arising from the issuance of incorrect tax documents due to errors in the data provided when placing the online Order. The Customer is solely responsible for ensuring their correct entry.
Sale via e-commerce service
An online sales contract is a distance contract for the sale of movable goods (hereinafter, Products) entered into between the Customer and Martelli Srl, as the Seller, within the scope of an e-commerce service organized by the Seller, which, for this purpose, uses the remote communication technology known as the Internet.
To conclude a purchase contract for one or more Products, the Customer must complete the electronic Order form (hereinafter, the Order) and send it to the Seller via the Internet following the relevant instructions.
Although Martelli Srl constantly takes measures to ensure that the photographs displayed on the website are faithful reproductions of the original products, including the adoption of every possible technological solution to minimize inaccuracies, some variations are always possible due to the technical characteristics and color resolution of the computer used to view them by the Customer. Consequently, the Seller will not be responsible for any inadequacy of the graphic representations of products displayed on the website, if due to the aforementioned technical reasons, since such representations are for illustrative purposes only.

Before concluding the contract, the Customer will be asked to confirm that they have read the General Conditions of Sale, including the information on the right of withdrawal and the processing of personal data.
The contract is concluded when the Seller receives the Order Form sent by the Customer online, after verifying the accuracy of the Order data.
The language available for concluding the contract with the Seller is Italian, and the applicable law is Italian law.
Once the contract is concluded, the Seller will process the Order.
Order Processing. By submitting the Order online, the Customer unconditionally accepts and undertakes to comply with these General Conditions of Sale in all dealings with the Seller.
Once the contract is concluded, the Seller will send the Customer an Order Confirmation by email, containing a summary of the information.
The Seller reserves the right, before sending the Order Confirmation, to request further information from the Customer via email or the telephone number indicated regarding the Order sent over the Internet.

The Seller may not process purchase orders that do not provide sufficient guarantees of solvency, are incomplete, or are incorrect, or if the products are unavailable. In these cases, the Seller will inform the Customer by email that the contract has not been concluded, specifying the reasons, and that the Seller has not fulfilled the Order. In this case, the amount previously committed to the Customer's payment method will be released.
If, after the Customer has placed the Order, the products displayed on the website are no longer available or for sale, the Seller will notify the Customer promptly and in any case within thirty (30) business days from the day following the day on which the Customer sent the Order to the Seller. In this case, the amount previously committed to the Customer's payment method will be released.
Each sale made by the Seller through the online sales service may concern one or more products, with no quantity limit for each item.
Martelli Srl reserves the right to refuse orders from Customers with whom it is involved in a legal dispute regarding a previous Order. This applies equally to all cases in which Martelli Srl deems the Customer unsuitable, including, but not limited to, previous violations of the terms and conditions of the online purchase contract on the website or for any other legitimate reason, including if the Customer has been involved in fraudulent activity of any kind.

Sales Prices
Unless otherwise specified in writing, all Product prices and shipping and delivery costs listed on the website and in the Order are inclusive of VAT and expressed in euros. The prices indicated are always and exclusively those indicated on the website at the time the Order is placed online. Product prices and shipping and delivery costs may change without notice. The Customer is therefore required to verify the final sale price before placing the relevant Order.
All Products are shipped directly from Italy. Product prices and shipping and delivery costs listed on the website and in the Order, unless otherwise specified, do not include any costs related to customs duties and related taxes if the shipment is made to non-EU countries or to countries where applicable legislation requires import duties.
These costs are therefore the responsibility of the Customer and must be paid directly upon delivery of the Products, according to the instructions specified in the Order Confirmation.
Payment Methods
Payment for the Products and related shipping and delivery costs may be made using the methods indicated in the Order Form on the Martelli Gloves website, which are summarized below.
At the time of online purchase, upon confirmation of the Order, the relevant banking institution will only process the amount of the Order from the available funds on the Customer's credit card.
If, upon receipt of the Order package, the Customer wishes to exercise the right of withdrawal for any reason, following payment for the Products purchased online, the Seller will instruct the banking institution to credit the refunded amount directly to the Customer's credit card.

At no point during the purchase process will Martelli Srl be able to access the Customer's credit card information (for example, the credit card number or expiration date), which is transmitted via a secure connection using an encrypted protocol directly to the website of the entity managing the electronic payment. The Seller will not store this data in any computer archive. Therefore, under no circumstances can the Seller be held liable for any fraudulent or improper use of credit or prepaid cards by third parties.
Shipping and Delivery of Products
Each shipment contains: the ordered products; the relevant transport document/accompanying invoice; any accompanying documentation required based on the country of shipment; and any informational and marketing materials.
Delivery of Purchased Products
Purchased products will be delivered via Mailbox Etc., which will select the most suitable courier and ship to the shipping address indicated by the Customer on the Order with insured shipping.
Upon receiving the goods at their home, the Customer is required to verify the integrity of the packages. In the event of any anomalies, the Customer must have the courier accurately note them and refuse the delivery. Otherwise, the Customer will lose their right to exercise their rights.

Right of withdrawal and returns.
Martelli Srl intends to guarantee complete customer satisfaction. If for any reason the Customer is not satisfied with the order, or in the unfortunate event that products delivered do not conform to the order, pursuant to Art. 64 of Legislative Decree No. 206/2005, the Customer has the right to withdraw from the contract without penalty by following the instructions below: Returns can be made within 14 working days of receipt of the goods.

Non-Conforming Product Warranty
The Seller is responsible for any defects in the products offered on the site, including non-conformity of the items with the products ordered, pursuant to Italian law.
If the Customer entered into the contract as a Consumer (this definition means any natural person who uses the site for purposes other than their business or professional activity), this warranty is valid provided that both of the following conditions are met: The defect becomes apparent within one month of the date of delivery of the products; The Customer submits a formal complaint regarding the defects within a maximum of one month from the date on which the defect was recognized by the Customer; It is properly requested by email to eshop@martelligloves.it.
Specifically, in the event of non-conformity, the Customer who entered into the contract as a Consumer will have the right to have the products brought into conformity free of charge, through repair or replacement, or to obtain an appropriate price reduction or termination of the contract for the disputed goods and a subsequent refund of the price.

Customer Communications: The Customer acknowledges, accepts, and consents to the fact that all communications, notifications, certifications, information, reports, and any other documentation regarding transactions carried out, relating to the purchase of Products, will be sent to the email address provided during registration. The information can be downloaded on a durable medium in the manner and within the limits established by the Site. Modification and Updates: The Seller may make changes or amendments to these General Conditions of Sale at any time. Therefore, the Customer will be required to accept only the General Conditions of Sale in effect at the time of purchase. The new General Terms and Conditions of Sale will be effective from the date of publication on the website and in relation to purchase orders submitted after that date.
Applicable law, dispute resolution and jurisdiction. These General Terms and Conditions of Sale are governed by and will be interpreted in accordance with Italian law, without prejudice to any other mandatory prevailing law of the Customer's country of habitual residence. Consequently, the interpretation, execution and termination of the General Terms and Conditions of Sale are subject exclusively to Italian law, and any disputes inherent and/or arising therefrom shall be resolved exclusively by the Italian judicial authorities. Specifically, if the Customer is a Consumer, any disputes shall be resolved by the court of the place of domicile or residence of the Customer in accordance with the applicable law or, at the consumer's option in the event of action brought by the consumer, by the Court of Florence.
